Terms and Conditions

ALL RESERVATIONS WITH BIKEY TOURS ARE SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS

These Terms and Conditions apply to bookings made with Bikey Tours. By making a booking, paying a deposit or otherwise confirming your participation in a Bikey Tours trip, you acknowledge that you have read, understood and agreed to these Terms and Conditions.

HOW TO BOOK YOUR TRIP

A place on a Bikey Tours trip is secured by completing the online booking process and paying the required deposit.

Unless otherwise stated on the relevant tour page, the deposit is AUD $1,000 per person.

Your booking is confirmed once Bikey Tours has received your deposit and issued confirmation of your booking.

The deposit forms part of the total tour price and is not an additional charge.

All prices displayed by Bikey Tours are in Australian Dollars (AUD) unless otherwise stated.

Places on our tours are limited and availability is not guaranteed until your booking has been confirmed.

YOUR DEPOSIT

Your AUD $1,000 per person deposit is fully refundable if you cancel more than 120 days before the scheduled tour departure date.

If you cancel within 120 days of departure, the cancellation provisions set out below apply.

Where Bikey Tours cancels a trip, your rights will be determined by the section If Bikey Tours Cancels or Materially Changes a Trip below and your rights under applicable law, including the Australian Consumer Law.

FINAL PAYMENT

The remaining balance of your tour price is due 120 days before the scheduled tour departure date.

Bikey Tours will provide payment instructions before the balance becomes due.

If you make a booking within 120 days of departure, the full tour price will generally be payable at the time of booking unless Bikey Tours agrees otherwise in writing.

If final payment is not received by the due date, Bikey Tours may contact you to arrange payment and, after providing reasonable notice, may cancel your booking.

CANCELLATION BY YOU

We understand that circumstances change.

If you cancel your booking, the following cancellation conditions apply:

More than 120 days before departure:
Your payments, including your $1,000 deposit, will be refunded in full.

90 to 120 days before departure:
Bikey Tours may retain up to 50% of the total tour price to cover reasonable losses, supplier commitments and costs resulting from your cancellation.

Less than 90 days before departure:
Bikey Tours may retain up to 100% of the total tour price to cover reasonable losses, supplier commitments and costs resulting from your cancellation.

Bikey Tours will take reasonable steps to minimise losses arising from a cancellation, including taking into account any amounts recovered from suppliers or through successfully reselling your place where reasonably possible.

Any amount retained will be subject to applicable law and will not exceed amounts Bikey Tours is legally entitled to retain.

Nothing in this cancellation policy limits any rights or remedies you may have under the Australian Consumer Law.

We strongly recommend purchasing comprehensive travel insurance as soon as you book your tour, including appropriate cancellation cover.

TRANSFERRING YOUR BOOKING

If you cannot travel, please contact Bikey Tours as soon as possible.

Where reasonably practicable, Bikey Tours may allow you to transfer your booking to another person, subject to supplier restrictions, availability and any reasonable costs associated with the change.

Any request to transfer a booking must be approved by Bikey Tours in writing.

IF BIKEY TOURS CANCELS OR MATERIALLY CHANGES A TRIP

Occasionally circumstances may require Bikey Tours to cancel or materially alter a trip.

This may include circumstances involving safety concerns, insufficient participant numbers, supplier availability, severe weather, natural disasters, government action, civil disturbance, industrial action, transport disruption or other events outside our reasonable control.

If Bikey Tours cancels a trip before departure, we will advise you as soon as reasonably practicable and explain the options available to you.

Depending on the circumstances and your rights under applicable law, these may include transferring amounts paid to another Bikey Tours trip, accepting an alternative arrangement, or receiving a refund of amounts that Bikey Tours is required to refund.

Nothing in these Terms and Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Bikey Tours is not responsible for independently booked flights, accommodation or other travel arrangements that do not form part of your Bikey Tours booking, except to the extent liability cannot lawfully be excluded.

For this reason, we strongly recommend purchasing comprehensive travel insurance before committing to non-refundable travel arrangements.

ITINERARY CHANGES

Cycling tours take place in dynamic environments.

Routes, accommodation, meals, transfers, activities, ride distances, elevation, scheduled events and other elements of an itinerary may need to change because of weather, road conditions or closures, safety considerations, local events, supplier availability, transport disruption or circumstances outside Bikey Tours' reasonable control.

Bikey Tours may make reasonable changes to an itinerary where necessary for the safe and practical operation of the tour.

Where a significant change occurs before departure, we will endeavour to advise affected participants as soon as reasonably practicable.

Minor itinerary changes do not automatically entitle a participant to cancel or receive a refund, subject always to rights available under applicable law.

TRAVEL AND MEDICAL INSURANCE

Comprehensive travel insurance is required for participation in a Bikey Tours trip.

Your insurance should be appropriate for your circumstances and the activities included in your trip and should include, where available and appropriate, cover for:

  • overseas medical treatment and hospital expenses;
  • cycling activities undertaken during the tour;
  • emergency evacuation and repatriation;
  • trip cancellation and interruption;
  • lost, stolen or damaged luggage and equipment; and
  • travel delays and other unforeseen events.

You are responsible for understanding the terms, exclusions and limits of your insurance policy.

Bikey Tours may request evidence of appropriate travel insurance before departure.

Failure to obtain adequate insurance may result in you being unable to participate in the tour where Bikey Tours reasonably considers the absence of insurance creates an unacceptable risk.

HEALTH, FITNESS AND MEDICAL CARE

Bikey Tours trips are physically active cycling holidays.

The distance, elevation, terrain and difficulty vary between tours and between individual days.

Before booking, you should review the information provided for your selected tour, including the expected riding distances and elevation.

You are responsible for making an appropriate assessment of your ability to participate safely.

You must inform Bikey Tours before departure of any relevant medical condition, injury, allergy, dietary requirement or other circumstance that may reasonably affect your participation or that Bikey Tours should know about to assist you appropriately during the trip.

Where you are uncertain about your ability to participate, you should seek appropriate medical advice before travelling.

Bikey Tours does not provide medical advice.

If medical treatment or emergency transportation is reasonably required during the tour, you are responsible for the associated costs except to the extent otherwise required by law.

RIDER SAFETY AND RESPONSIBILITY

Cycling involves inherent risks, including falls, collisions, changing road surfaces, traffic, weather, mechanical failure and interaction with other road users.

Participants are expected to ride responsibly, follow applicable road rules, use appropriate safety equipment and follow reasonable safety directions provided by Bikey Tours, its guides and local suppliers.

Helmets must be worn while cycling.

You remain responsible for riding within your own capabilities and for deciding whether you are comfortable undertaking a particular ride, climb, descent or optional activity.

Where practical, Bikey Tours may provide shorter or alternative riding options. Availability will depend on the particular itinerary, location and operational circumstances.

Bikey Tours may require a participant to modify or cease an activity where we reasonably believe continuing would create an unacceptable risk to that participant, other guests, staff or members of the public.

BICYCLES AND EQUIPMENT

You are responsible for ensuring that any bicycle and personal cycling equipment you bring on the tour is safe, suitable and appropriately maintained.

Where bicycles or equipment are rented from a third-party provider, that provider's terms and conditions may also apply.

Bikey Tours is not responsible for normal wear and tear, mechanical failure or loss or damage to personally owned bicycles or equipment except where liability arises from Bikey Tours' conduct and cannot lawfully be excluded.

PASSPORTS, VISAS AND TRAVEL DOCUMENTS

You are responsible for ensuring that you hold all passports, visas, permits and other documents required for your trip.

Passport validity, visa requirements and entry conditions can change.

Any information provided by Bikey Tours concerning passports, visas, vaccinations or entry requirements is general information only. You remain responsible for checking the current requirements applicable to your nationality and circumstances with the relevant government authorities.

Bikey Tours is not responsible for loss arising from a participant's failure to obtain the required travel documents, except to the extent otherwise required by law.

TOUR START DATE AND TRAVEL ARRANGEMENTS

You are responsible for arriving at the nominated tour meeting point at the time specified in your final itinerary or joining instructions.

Unless expressly included in your tour package, flights to and from the tour destination are not included.

Bikey Tours is not responsible for cancelled or missed flights, changed flight schedules or late arrivals outside our control.

We recommend allowing sufficient time between international travel arrangements and the commencement of your tour.

ACCOMMODATION AND ROOMING

Accommodation arrangements are described on the relevant tour page or itinerary.

Tour prices are generally based on the rooming arrangement specified for that tour.

Where a single-room supplement is available, it will be subject to availability and additional cost.

Specific room configurations, views or hotel rooms cannot be guaranteed unless expressly confirmed by Bikey Tours in writing.

THIRD-PARTY SUPPLIERS

Bikey Tours works with independent accommodation providers, transport operators, restaurants, bicycle rental providers, guides and other suppliers to deliver elements of our tours.

These suppliers may operate under their own terms and conditions and are responsible for the services they provide.

Bikey Tours will exercise reasonable care in selecting and coordinating suppliers but does not control every aspect of independently provided services.

Nothing in this section excludes or limits liability that Bikey Tours has under applicable law.

FORCE MAJEURE AND EVENTS OUTSIDE OUR CONTROL

Events may occur that are outside the reasonable control of Bikey Tours or its suppliers.

These may include severe weather, natural disasters, fire, flood, epidemic or pandemic, government restrictions, border closures, civil unrest, terrorism, war, industrial action, transport disruption, road closures or other comparable events.

Where such an event affects a tour, Bikey Tours will take reasonable steps to communicate with participants and, where practicable, provide an appropriate alternative arrangement.

The rights and remedies available to you will depend on the circumstances, the services affected, supplier arrangements and applicable law.

Nothing in this section limits rights that cannot lawfully be excluded under the Australian Consumer Law.

LOCAL LAWS AND TOUR CONDUCT

Participants must comply with applicable laws and regulations in the countries and regions visited.

You are expected to behave respectfully towards other participants, Bikey Tours staff, suppliers, local communities and members of the public.

Bikey Tours may remove a participant from a tour where their behaviour presents a serious safety risk, involves unlawful conduct, or materially interferes with the safety or reasonable enjoyment of other participants.

Any such decision will be made reasonably and having regard to the circumstances.

PHOTOGRAPHY AND VIDEO

Photographs and video may be taken during Bikey Tours trips.

Bikey Tours may ask participants for permission to use photographs or video for promotional purposes, including on our website and social media channels.

If you do not wish identifiable photographs or video of you to be used for promotional purposes, please tell Bikey Tours in writing.

We will respect reasonable requests not to use identifiable images of you for marketing purposes.

PERSONAL INFORMATION

Bikey Tours collects personal information reasonably necessary to administer bookings and operate tours.

This may include contact information, emergency contact information, dietary requirements, relevant health information and travel details.

We will handle personal information in accordance with applicable privacy laws and our Privacy Policy.

Information may be provided to relevant suppliers where reasonably necessary to operate your trip, including accommodation providers, guides, transport providers or emergency services.

COMPLAINTS AND PROBLEMS DURING YOUR TOUR

If you experience a problem during your tour, please tell a Bikey Tours representative as soon as reasonably possible.

Giving us an opportunity to address an issue while the tour is underway will often allow us to resolve it quickly.

If the issue cannot be resolved during the trip, please contact Bikey Tours after the tour with details of your concern.

Nothing in this process limits your rights under applicable consumer law.

AUSTRALIAN CONSUMER LAW

Our services come with guarantees that cannot be excluded under the Australian Consumer Law where that law applies.

Nothing in these Terms and Conditions is intended to exclude, restrict or modify any guarantee, right or remedy available to you under the Australian Consumer Law or other applicable law where doing so would be unlawful.

If any provision of these Terms and Conditions is inconsistent with a right that cannot lawfully be excluded, that provision will apply only to the extent permitted by law.

GOVERNING LAW

These Terms and Conditions are governed by the laws of Australia and the applicable State or Territory in which Bikey Tours operates, subject to any laws that apply compulsorily to the booking.
